With this said - a prime example to look at is the mods looking to port and remake Morrowind and Oblivion in the Skyrim engine - HUGE undertakings, absolute passion projects - and Bethesda could reasonably Cease and desist them. They can basically choose to enforce / not enforce on a whim, purely based on whimsy.
